Specifically, an ENDS product is defined as “any electronic device that, through an aerosolized solution, delivers nicotine, flavor, or any other substance to the user inhaling from the device,” including “an e-cigarette; an e-hookah; an e-cigar; a vape pen; an advanced refillable personal vaporizer; an electronic pipe; and any component, liquid, part, or accessory of a device described [above], without regard to whether the component, liquid, part, or accessory is sold separately from the device.” (Emphasis added.) Based on this definition of ENDS, zero-nicotine e-liquids, synthetic “tobacco-free” nicotine e-cigarettes, and CBD/THC/hemp vape pens, among other things, would all appear to be captured.

Is there a B2C ban on vaping?
The ban on Postal Service shipping, combined with the decision by the major private carriers to end vape product deliveries, poses a true existential crisis for online vaping retail ers and manufacturers who ship business-to-customer (B2C). And for vapers in rural areas and cities without vape shops it could mean the end of easily available open-system products.

Check your exception status: Historically, the PACT Act has exempted business-to-business deliveries from the USPS ban. USPS has stated that it plans to extend this B2B exception for ENDS products. If you’re sending vapor products “for business purposes” to another business, you’ll need to apply with the USPS Pricing and Classification Service Center. You’ll also need to required to observe the registration and reporting requirements listed above. More clarification is forthcoming from USPS on B2B vape shipping.
Who keeps a list of persons who fail to comply with the Pact Act?
Stay compliant: The ATF maintains a list of persons who fail to comply with the PACT Act, and distributes this list to common carriers, USPS, credit card companies, and other entities to ensure that you are unable to get around the prohibitions.
